Terms and Conditions
1. Acceptance of These Terms
Welcome to the Krewe of Cleopatra. These Terms and Conditions (“Terms”) are a binding agreement between you and Krewe of Cleopatra, Inc., a Louisiana non-profit corporation (“the Krewe,” “we,” “us,” or “our”). They govern your use of our website at kreweofcleopatra.org (the “Site”) and your participation in Krewe membership, purchases, events, and activities.
By using the Site, creating or accessing a member account, joining or renewing membership, making a purchase, entering a raffle or court drawing, or participating in any Krewe event, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Site or participate in our programs.
Please read the sections on refunds, store credit, assumption of risk, and limitation of liability carefully, because they affect your legal rights and obligations.
2. Eligibility
To purchase membership, ride in the parade, or otherwise participate as a member, you must be an adult of legal age (generally eighteen years of age or older) and able to enter into a binding contract. Participation by a minor is permitted only under the supervision and responsibility of a parent or legal guardian, who agrees to these Terms on the minor’s behalf and remains responsible for the minor’s conduct, dues, and compliance.
You are responsible for meeting any additional eligibility, membership, or riding requirements that the Krewe publishes for the applicable membership year.
3. Your Account and Accurate Information
You may need an account to access member features, dues, packages, and event purchases. You agree to provide accurate, current, and complete information and to keep it up to date, including your name, contact details, and mobile number if you choose to receive text messages. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly if you believe your account has been used without your permission.
4. Membership and Dues
Krewe membership requires payment of the annual membership dues and any mandatory packages published on the Site for the applicable membership year. The current dues, fees, and packages, along with the deadlines that apply to them, are published on the Site and may change from year to year. By joining or renewing, you agree to pay the amounts published for your membership year by the applicable deadlines.
Membership dues and any deposit paid toward dues are non-refundable. Membership is personal to you and may not be transferred or assigned to another person.
5. Payments and Billing
Online payments are processed by third-party payment processors, including Braintree (a PayPal service) and PayPal. When you pay online, your card and payment information is collected and handled by the processor under its own terms of service and privacy policy. The Krewe does not store your full payment-card number.
You agree to pay all amounts you authorize, including dues, packages, throws, merchandise, tickets, raffle entries, and court capsule entries, together with any applicable charges. You represent that you are authorized to use any payment method you submit.
6. Payment Plans and Layaway
Some items may be offered on a payment plan or layaway. A payment plan requires an initial deposit followed by one or more later installments, each due by the deadlines published for the applicable membership year.
– Deposits are non-refundable.
– If the balance is not paid in full by the published deadline, you forfeit both the deposit and the item, and the item may be returned to inventory and made available to others.
– The Krewe may withdraw or discontinue the layaway option for any item at any time. Withdrawing the option does not entitle you to a refund of any deposit or installment already paid, which remains subject to the non-refundable and forfeiture rules above.
– Layaway cannot be combined with any other offer or discount.
Enrolling in a payment plan does not change the refund terms in these Terms. All amounts paid remain subject to the refund, store-credit, and forfeiture rules stated here.
7. Throws, Merchandise, and Delivery
Throws are the beads, trinkets, and items members hand out from the floats on parade day. Merchandise includes other Krewe goods sold on the Site. Throw and merchandise orders are assembled and fulfilled through Our Krewe Logistics, the Krewe’s logistics provider.
You will be notified of the delivery or pickup arrangements for your order, and throws are distributed for parade day. The timing of delivery or pickup, and the point at which title and risk of loss pass to you, are communicated by the Krewe. Please follow the instructions you receive so that your items are ready for the parade.
8. Refunds, Exchanges, and Store Credit
This is an important, settled policy of the Krewe. Please read it carefully before you buy. The full policy is also published on our Refund and Returns Policy page.
Throws and merchandise are non-refundable and non-transferable. Once purchased, throws and merchandise cannot be refunded, and they cannot be moved to another member or to a substitute rider. If you do not ride, your only remedy is store credit. Store credit may be applied toward any Krewe of Cleopatra payment on the Site (the webstore). Store credit has no cash value, is issued to and usable only by the member to whom it was granted, may not be redeemed for cash, and is subject to any expiration or other conditions published on the webstore.
Membership dues and any deposit toward dues are non-refundable, as described above. Raffle entries are non-refundable. Event tickets and court capsule entries are subject to the specific terms in the sections below.
Because these items are prepared and committed for a specific parade and membership year, we are not able to make exceptions to these rules. If you have questions before you purchase, please contact us.
9. Event Tickets
The Krewe sells tickets to events such as the Rendezvous or Coronation Ball and the after-party. By purchasing a ticket, you agree that:
– Tickets are non-transferable. Resale of tickets is prohibited, and the Krewe may cancel any ticket that is resold.
– Rendezvous (Coronation Ball) tickets may be refunded only by request and only if approved by the Krewe, and only up to the cutoff date published on the Krewe’s Rendezvous ticket-refund page. A refund covers the value of the ticket only and does not include processing fees or taxes.
– All other tickets, including after-party tickets, are non-refundable.
– Lost or damaged tickets will not be honored.
– The Krewe may refuse or revoke admission, without refund, for disorderly or unbecoming conduct.
To request a Rendezvous ticket refund, use the request form on the Krewe’s Rendezvous ticket-refund page (members only). Admission to any event is also subject to the conduct, safety, and event-change terms in these Terms.
10. Raffle Entries
The Krewe may offer raffle entries. Raffle entries are non-refundable. Raffles are conducted in accordance with the rules published for the applicable drawing and with applicable law. Purchasing an entry does not guarantee a prize.
11. Court Capsule Entries (Queen and Jewel Drawing)
Members may purchase court “capsule” entries for the Queen and Jewel drawing. Court requirements are published for the applicable membership year. If a member does not meet, or does not agree to, the published court requirements, all capsules in that member’s name are pulled from the drawing before the official selection, with no refund.
By entering, you agree to the published court requirements and to this forfeiture rule.
12. Text Message (SMS) Program
The Krewe offers a text-message (SMS) program, operated on the Krewe’s behalf by Our Krewe Logistics, to keep members informed.
How you opt in. You opt in by providing your mobile number and affirmatively checking the SMS consent checkbox during membership signup or renewal at kreweofcleopatra.org, and/or through the phone-verification prompt in the member area. Your consent is recorded. Only members who have consented receive messages.
Consent is not required to buy or to join. Consent to receive text messages is not a condition of membership or of any purchase.
What we send. Messages may include parade-day logistics (such as lineup times, staging locations, and schedule changes), dues and membership reminders, event and ticket announcements, and account security or verification messages (such as one-time passcodes or two-factor authentication).
How to stop. You can opt out at any time by replying STOP to any message. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT. Reply HELP for help, or contact [email protected].
Rates and delivery. Message and data rates may apply. Message frequency varies. Neither the Krewe nor the mobile carriers are liable for delayed or undelivered messages.
SMS support. For help with the text-message program, contact [email protected]. For other membership questions, you may also email [email protected].
13. Parade Participation, Conduct, and Safety
Riding in the parade and participating in Krewe events is a privilege that carries responsibilities. Members and their guests must follow the Krewe’s Conduct and Safety Policy and all safety-equipment requirements, including any required harness or other equipment specified by the Krewe.
Violation of the Conduct and Safety Policy may result in termination of membership. The Krewe may refuse or revoke participation or admission, without refund, for conduct that is disorderly, unsafe, or unbecoming.
14. Assumption of Risk
Riding in the parade and participating in Krewe events involve inherent risks, including the risk of injury, death, loss, or property damage. By participating, you and your guests voluntarily and knowingly assume all such risks, whether they arise before, during, or after any event, to the fullest extent permitted by law. You are responsible for your own safety and the safety of your guests, and for following all instructions and safety requirements given by the Krewe.
15. Photography, Media, and Likeness
The Krewe may photograph or record its events. By participating, you agree that the Krewe may use your image or likeness in Krewe photographs, video, and promotional or informational material.
16. Event Changes and Cancellations
The Krewe may postpone, cancel, interrupt, or modify any event, including the route, times, program, or capacity, for weather, safety, or any cause beyond its reasonable control, without refund. We will make reasonable efforts to communicate changes to members.
17. Privacy
We respect your privacy. We collect and use personal information, such as your name, contact details, mobile number, and order history, to process your orders and payments, administer membership and dues, operate our events and drawings, provide account security, and communicate with you about the Krewe. Payment-card information is handled by our third-party payment processors under their own terms and privacy policies, and the Krewe does not store your full card number.
We share your information only as needed to run the Krewe, for example with our logistics and text-message provider, Our Krewe Logistics, and with our payment processors, or as required by law. For more detail on how we collect, use, and share your information, please see our Privacy Policy. If you have questions about how your information is handled, please contact us using the information below.
18. Acceptable Use of the Website
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to interfere with or disrupt the Site or its security, attempt to gain unauthorized access to any account or system, use the Site to transmit harmful or unlawful content, or use automated means to access or scrape the Site without our permission. We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe is harmful to the Krewe, its members, or others.
19. Intellectual Property
The Site and its content, including text, graphics, logos, images, and the Krewe’s names and marks, are owned by the Krewe or its licensors and are protected by law. You may not copy, reproduce, distribute, modify, or create derivative works from Krewe content or marks without our prior written permission, except as necessary for your own personal, non-commercial use of the Site as a member.
20. Disclaimers
The Site and all Krewe programs, events, throws, merchandise, and services are provided on an “as is” and “as available” basis, to the fullest extent permitted by law. The Krewe makes no warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Krewe does not warrant that the Site will be uninterrupted, secure, or error-free, or that any event will occur as scheduled.
21. Limitation of Liability
To the fullest extent permitted by law, the Krewe and its officers, directors, board members, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Site, your membership, your purchases, or your participation in any event. This applies whether a claim is based on contract, tort, or any other legal theory, and even if the Krewe was advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of the Krewe for any claim arising out of or relating to these Terms, your purchases, or your participation will not exceed the amount you paid to the Krewe for the specific item, event, or membership giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
22. Indemnification
You agree to indemnify, defend, and hold harmless the Krewe and its officers, directors, board members, volunteers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees. This applies to claims arising out of or relating to your use of the Site, your participation in any event, your conduct, your breach of these Terms, or your violation of any law or the rights of any third party.
23. Changes to These Terms
The Krewe may modify these Terms from time to time. When we do, we will update the effective date below and post the revised Terms on the Site. Your continued use of the Site or continued participation after changes are posted constitutes your acceptance of the revised Terms. Please review these Terms periodically.
24. Governing Law and Venue
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms, the Site, your membership, your purchases, or your participation will be brought exclusively in the state courts located in St. Tammany Parish, Louisiana, or in the United States District Court for the Eastern District of Louisiana, and you consent to the personal jurisdiction and venue of those courts.
25. Miscellaneous
Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with any policies and rules published on the Site for the applicable membership year, make up the entire agreement between you and the Krewe regarding their subject matter and supersede any prior understandings.
Force Majeure
The Krewe is not responsible for any failure or delay in performance caused by events beyond its reasonable control, including weather, natural disasters, fire, flood, acts of government, public-health emergencies, labor disputes, utility or network failures, or other causes beyond its reasonable control.
No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
26. Contact Us
